1. Definitions and Service Object

These Terms and Conditions ("Terms") govern the use of the PayToZ digital payment platform ("Platform"), accessible via the domain paytoz.com. The Platform facilitates online payment transactions between consumers and businesses within the scope of Italian e-commerce, acting as a technological intermediary.

The object of the service is to provide a secure and reliable technological infrastructure for processing digital payments. PayToZ does not guarantee the commercial success of its users' activities nor assumes responsibility for any commercial disputes between buyers and sellers.

2. Acceptance and Modifications of the Terms

Accessing and using the Platform constitutes full and binding acceptance of these Terms. PayToZ reserves the right to modify these Terms at any time. Modifications will be effective from their publication on the Platform. The user is required to periodically check the Terms. Continued use of the Platform after modifications constitutes acceptance of the new conditions.

3. Rights and Obligations of the Parties

3.1 PayToZ's Obligations

PayToZ undertakes to provide the service with professional diligence, maintaining adequate security standards for the protection of transaction data. The Platform reserves the right to temporarily interrupt the service for maintenance or updates, providing notice where possible.

3.2 User's Obligations

The user is responsible for the truthfulness of the information provided, the security of their login credentials, and the use of the Platform in compliance with applicable laws. They must immediately notify any unauthorized use of their account.

• Maintain the confidentiality of passwords and access codes.
• Do not attempt to compromise the security or functionality of the Platform.
• Pay any service fees according to the published rates.

4. Limitations of Liability

PayToZ provides the service "as is" and "as available", without warranties of any kind, express or implied, including, by way of example, suitability for a particular commercial purpose. In no event shall PayToZ be liable for indirect, consequential, or special damages arising from the use or inability to use the Platform.

PayToZ's liability is in any case limited to the amount of fees paid by the user in the six months preceding the event that caused the damage. PayToZ is not responsible for service interruptions caused by force majeure or factors outside its reasonable control.

5. Payments, Fees, and Refunds

The fees for using the payment services are indicated in the dedicated section of the website. PayToZ may modify the fees with 30 days' notice. Transactions are handled via third-party payment partners; PayToZ does not hold user funds except for due service fees.

Any refund requests for transactions must be handled directly between the buyer and the seller, according to their policies. PayToZ may intervene as an intermediary only in cases provided by law and according to its operational policies, without any guarantee of result.

6. Intellectual Property and Data

All intellectual property rights to the Platform, its software, and its contents are owned by PayToZ or its licensors. Any unauthorized reproduction is prohibited.

Users' personal data is processed according to the Privacy Policy (available at policy.html). The user grants PayToZ a limited license to use transaction data solely for the purpose of providing and improving the service.

7. Termination and Applicable Law

These Terms are governed by and interpreted according to Italian law. Any dispute relating to the interpretation or execution of these Terms shall fall under the jurisdiction of the Court of Milan.
